I remember well a particular jury trial in the mid-1980’s in which I represented a client in a medical malpractice case against a plastic surgeon.

As a general rule, the cross-examination of an opposite party is well-planned and controlled at trial.

This particular doctor had revealed himself to me when I had earlier taken his discovery deposition. He was arrogant and sanctimonious. He thought he could convince anyone that he was right and my client was wrong. He loved to attack my client with subtle jabs and insults. He thought very highly of himself to put it mildly. He was a real character.

At the trial, I made the decision to break all the conventional rules of cross-examination. Instead of asking leading questions, I asked direct questions to which he could talk and talk and talk. I let him drone on for 4 hours telling his story to the jury.

The lawyer who set second chair with me while I tried the case did not understand why I let the doctor talk freely for so long on cross-examination in front of the jury.

I knew that if I gave the doctor enough rope, he would hang himself in front of the jury. He did.

Result: A record jury verdict at the time in favor of my client.

Many lawyers and so-called “experts” look down their noses at the average citizens who make up most juries.

I know that if you give certain people enough rope and enough time, they will reveal themselves to others.

People are much smarter than the elite think they are.

I have faith in You The People. The enemies insultingly refer to you as “deplorables,” “whackadoodles,” and even “Lintards.”

I pray you have faith in the people too. That you have faith in yourself to know truth from lie, real from fake.

In time, You The People know truth-givers from masters of deceit and illusion.
